Terms of Service

By downloading or using Duly AI, you agree to these Terms of Service. If you do not agree, please do not use the app.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Duly AI mobile application ("App") operated by Duly AI ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms.

2. Description of Service

Duly AI is a personal finance management application that provides:

Voice-powered expense logging using AI
Receipt scanning and OCR processing
Group bill splitting and expense sharing
Budget tracking and financial insights
Automation integrations (Apple Shortcuts, email parsing)

The App is available in free and paid (Pro) tiers. Features available in each tier are described in the App and on our website.

3. User Accounts

You must create an account to use Duly AI. You are responsible for:

Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Providing accurate and current information
Notifying us immediately of any unauthorized account access

You must be at least 13 years old to create an account. By creating an account, you represent that you meet this age requirement.

4. Subscriptions and Payments

Free Tier

The free tier of Duly AI is available at no charge and includes limited features as described in the App. The free tier includes advertising served by Google AdMob.

Pro Subscription

Duly Pro is available as a monthly ($5.99/month) or annual ($49.99/year) subscription. Subscriptions are processed through Apple's App Store and managed by RevenueCat.

Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
You can manage and cancel subscriptions in your Apple ID account settings
No refunds are provided for partial subscription periods
Prices may change with 30 days advance notice

Free Trial

If a free trial is offered, it will automatically convert to a paid subscription unless cancelled before the trial period ends.

5. Acceptable Use

You agree not to use Duly AI to:

Violate any applicable laws or regulations
Upload malicious content or attempt to compromise the App's security
Attempt to reverse engineer or extract the App's source code
Use the App for any commercial purpose without our written consent
Impersonate any person or entity
Harass, abuse, or harm other users
Upload content that violates intellectual property rights

6. Your Content

You retain ownership of all content you create in Duly AI, including expense data, notes, and uploaded receipts. By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service.

You are responsible for ensuring you have the right to upload any content (e.g., receipt images).

7. AI and Voice Features

Duly AI uses Google's Gemini AI to power voice and text-based interactions. Please note:

AI responses are generated automatically and may not always be accurate
Do not rely solely on AI-generated financial advice for important financial decisions
Voice data is processed in real-time and is not stored as audio recordings
AI features require an internet connection

8. Privacy

Your use of Duly AI is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Intellectual Property

The Duly AI app, including its design, code, trademarks, and content (excluding your user content), is owned by Duly AI and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

10. Disclaimer of Warranties

DULY AI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. WE DO NOT PROVIDE FINANCIAL, LEGAL, OR TAX ADVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DULY AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR FINANCIAL LOSSES ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Duly AI and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time in Settings → Account → Delete Account. Upon termination, your data will be deleted within 30 days.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via push notification or email. Continued use of the App after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
